The Supreme Court on Monday dismissed a petition filed by the lawyer representing a transgender person who alleged she was violated by the Kerala High Court’s order for the removal of a man’s beard from a public square in Kottayam district.
The bench of Chief Justice D.K. Narayanan and Justice Dinesh Sharma, while rejecting the plea filed by Dr Ananth Kumar, found no basis for it.
Dr Kumar, a lawyer and activist, had earlier lodged a complaint against the Kerala Government alleging that it violated his human rights under the Constitution and the Right to Privacy Act by allowing the removal and relocation of a person’s beard on public grounds.
The state government has appealed the High Court order to the Supreme Court.
The High Court has said it would decide the matter on March 24.
Dr Sharma has appealed against the order to a three-judge Constitution bench of the Supreme Judicial Council.
The petition has been filed by his advocate and the Kerala Chief Minister.
